The terms “we”, “us”, “our” and “Popmenu” refer to Popmenu LLC, a Georgia corporation and/or our subsidiaries. The term “you” refers to the customer visiting the Website and/or contributing content on this Website.

This Website is offered to you conditioned upon your acceptance without modification of any/all the terms, conditions, and notices set forth below (collectively, the “Agreement”). By accessing or using this Website in any manner, you agree to be bound by the Agreement and represent that you have read and understood its terms.

Please read the Agreement carefully, as it contains information concerning your legal rights and limitations on these rights, as well as a section regarding applicable law and jurisdiction of disputes. If you do not accept all of these terms and conditions, please do not use this Website.

We may change or otherwise modify the Agreement in the future, and you understand and agree that your continued access or use of this Website after such change signifies your acceptance of the updated or modified Agreement. Popmenu does not knowingly collect the information of anyone under the age of 13. We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer, at any time and for any reason, including, but not limited to, for violation of this Agreement.

The content and information on this Website (including, but not limited to, data, information, messages, text, photos, sound, graphics, video, maps, icons, software, code or other material), as well as the infrastructure used to provide such content and information, is proprietary to us.

You agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through this Website.

Additionally, you agree not to:
(i) use this Website or its contents for any commercial purpose

(iii) violate the restrictions in any robot exclusion headers on this Website or bypass or circumvent other measures employed to prevent or limit access to this Website;

In certain circumstances we may disclose information about you to third parties if we determine, in our sole discretion, such disclosure is necessary (a) to protect Popmenu’s systems, assets, employees, members and customers; (b) to ensure the integrity and operation of Popmenu’s business and systems; or (c) to comply with legitimate and enforceable governmental requests, subpoenas or court orders.

We may choose to comply with or disregard such requests or orders in our sole discretion. Popmenu’s right to disclose information, including but not limited to user profile information (i.e. name, email address, etc.), IP addressing and traffic information, usage history, and posted Content, shall take precedence over any terms of Popmenu’s Privacy Policy.

REVIEWS, COMMENTS AND USE OF OTHER INTERACTIVE AREAS

We appreciate your contributions to Popmenu. Please be aware that by submitting content to this Website by email, postings on this Website or otherwise, including any restaurant reviews, questions, photographs or videos, comments, suggestions, ideas or the like contained in any submissions (collectively, “Submissions”), you grant Popmenu and its affiliates a nonexclusive, royalty-free, perpetual, transferable, irrevocable and fully sublicensable right to use such Submissions as described herein.

You acknowledge that Popmenu may choose to provide attribution of your comments or reviews at our discretion. You further grant Popmenu the right to pursue at law any person or entity that violates your or Popmenu’s rights in the Submissions by a breach of this Agreement. You acknowledge and agree that Submissions are non-confidential and non-proprietary.

This Website may contain discussion forums, bulletin boards, review services or other forums (“Interactive Areas”). If Popmenu provides such Interactive Areas, you are solely responsible for your use of such Interactive Areas and use them at your own risk.

By using any Interactive Areas, you expressly agree not to post Content that is unlawful, infringing, obscene, abusive, misleading, harmful, or otherwise objectionable, including but not limited to the categories listed below.

Popmenu takes no responsibility and assumes no liability for any Content posted by users. Although Popmenu has no obligation to screen or monitor Content, it reserves the right to remove or edit Content at its discretion without notice.

If it is determined that you retain moral rights in the Content, you hereby waive and release all such rights as described above.

Any use of the Interactive Areas in violation of this Agreement may result in suspension or termination of your access.

BOOKING WITH THIRD-PARTY SUPPLIERS THROUGH POPMENU

Use of Instant Booking allows you to book restaurant reservations with third-party suppliers without leaving the Popmenu experience. By doing so, you become a Popmenu member if you are not already one.

By using Instant Booking, you agree to these terms, confirm you are 18 years or older, and agree to provide accurate information and make only legitimate reservations.

Popmenu transmits payment information to suppliers, but suppliers (not Popmenu) process payments and fulfill reservations.

Popmenu is not responsible for third-party suppliers’ acts, omissions, or errors, and your interactions with them are at your own risk.

LIABILITY DISCLAIMER

PLEASE READ THIS SECTION CAREFULLY.

The Website and all content and services are provided “AS IS” without warranty of any kind. Popmenu disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

Popmenu shall not be liable for any damages arising out of your use of the Website, including indirect, incidental, or consequential damages, even if advised of the possibility of such damages.

If Popmenu is found liable, its total liability shall not exceed the greater of the fees paid or $100.

INDEMNIFICATION

You agree to defend and indemnify Popmenu and its affiliates from any claims arising out of your breach of this Agreement, your violation of law, or your use of the Website.

SOFTWARE AVAILABLE ON THIS WEBSITE

Popmenu software is provided subject to U.S. export laws and applicable license agreements. Unauthorized copying or redistribution is prohibited and may result in civil or criminal penalties.

JURISDICTION AND GOVERNING LAW

GENERAL PROVISIONS

This Agreement constitutes the entire agreement between you and Popmenu. If any provision is found unenforceable, the remainder remains in effect.

ADDITIONAL DETAILS

Room Rate: The quoted rate is per night, based on the number of guests listed. Changes to your reservation may affect availability and pricing.

Check-In/Check-Out: Check-in is at 3:00 pm; check-out is by 11:00 am.

Deposit: For bookings made up to 15 days prior to arrival, a 50% deposit was collected. For reservations within 14 days of arrival, full payment was processed at the time of booking.

Final Payment: Final payment will be processed 14 days prior to arrival to the card on file. If you’d like to use a different payment method, please contact our Front Desk before that time.

Cancellation Policy: Cancellations made 14 or more days before arrival will be refunded, minus a $20 processing fee. Cancellations within 14 days of arrival are non-refundable.
